The data processing on this website is carried out by the website operator. You can find their contact details in the section “Notice on the Responsible Party” in this privacy policy.

Your data is collected, on the one hand, by you providing it to us. This can be data that you enter in a contact form, for example.

Other data is automatically collected by our IT systems when you visit the website, either automatically or with your consent. This primarily includes technical data (e.g., internet browser, operating system, or time of the page view). This data is collected automatically as soon as you access this website.

For what purpose do we use your data?

Some of the data is collected to ensure error-free provision of the website. Other data may be used to analyze your user behavior.

What rights do you have regarding your data?

You have the right to obtain information about the origin, recipient, and purpose of your stored personal data at any time, free of charge. You also have the right to request the restriction of the processing of your personal data under certain circumstances. Furthermore, you have the right to lodge a complaint with the competent supervisory authority.

You can contact us at any time regarding these and other questions on the subject of data protection.

You can find details in the privacy policy of Hetzner: https://www.hetzner.com/de/legal/privacy-policy/.

The use of Hetzner is based on Art. 6 para. 1 lit. f GDPR. We have a legitimate interest in ensuring that our website is displayed as reliably as possible. If consent was requested, the processing is carried out exclusively on the basis of Art. 6 para. 1 lit. a GDPR and § 25 para. 1 TTDSG, insofar as the consent includes the storage of cookies or access to information on the user’s terminal device (e.g., device fingerprinting) within the meaning of the TTDSG. Consent can be revoked at any time.

Order Processing

We have concluded a contract for order processing (AVV) with the above-mentioned provider. This is a contract required by data protection law that ensures that this provider processes the personal data of our website visitors only in accordance with our instructions and in compliance with the GDPR.

3. General Information and Mandatory Information

Data Protection

The operators of this site take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the statutory data protection regulations and this privacy policy.

When you use this website, various personal data are collected. Personal data is data with which you can be personally identified. This privacy policy explains what data we collect and what we use it for. It also explains how and for what purpose this is done.

We would like to point out that data transmission over the Internet (e.g., when communicating by e-mail) can have security gaps. Complete protection of the data against access by third parties is not possible.

Notice on the Responsible Party

The responsible party for data processing on this website is:

Mag. Benjamin Ergün
Weidmanngasse 27/10
A-1170 Vienna

Phone: +43 (0) 676/62 66 792
E-Mail: office@rhythmiker.com

The responsible party is the natural or legal person who alone or jointly with others determines the purposes and means of the processing of personal data (e.g., names, e-mail addresses, etc.).

Storage Duration

Unless a more specific storage period has been specified within this privacy policy, your personal data will remain with us until the purpose for the data processing no longer applies. If you make a legitimate request for deletion or revoke your consent to data processing, your data will be deleted unless we have other legally permissible reasons for storing your personal data (e.g., tax or commercial law retention periods); in the latter case, the data will be deleted once these reasons no longer apply.

General Information on the Legal Basis of Data Processing on this Website

If you have consented to data processing, we process your personal data on the basis of Art. 6 para. 1 lit. a GDPR or Art. 9 para. 2 lit. a GDPR if special categories of data are processed according to Art. 9 para. 1 GDPR. In the case of explicit consent to the transfer of personal data to third countries, the data processing is also based on Art. 49 para. 1 lit. a GDPR. If you have consented to the storage of cookies or to the access to information on your terminal device (e.g., via device fingerprinting), the data processing is also carried out on the basis of § 25 para. 1 TTDSG. Consent can be revoked at any time. If your data is required for the fulfillment of a contract or for the implementation of pre-contractual measures, we process your data on the basis of Art. 6 para. 1 lit. b GDPR. Furthermore, we process your data if it is necessary to fulfill a legal obligation on the basis of Art. 6 para. 1 lit. c GDPR. The data processing may also be carried out on the basis of our legitimate interest according to Art. 6 para. 1 lit. f GDPR. The specific legal basis applicable in each case will be indicated in the following paragraphs of this privacy policy.

Note on Data Transfer to the USA and Other Third Countries

We use tools from companies based in the USA or other countries that do not have adequate data protection standards. When these tools are active, your personal data may be transferred to these third countries and processed there. We would like to point out that in these countries, no data protection level comparable to that in the EU can be guaranteed. For example, US companies are required to hand over personal data to security authorities without you as the data subject being able to take legal action against this. Therefore, it cannot be ruled out that US authorities (e.g., intelligence services) may process, analyze, and permanently store your data stored on US servers for surveillance purposes. We have no influence over these processing activities.

Revocation of Your Consent to Data Processing

Many data processing operations are only possible with your express consent. You can revoke any consent you have already given at any time. The legality of the data processing carried out until the revocation remains unaffected by the revocation.

Right to Object to Data Collection in Special Cases and to Direct Advertising (Art. 21 GDPR)

IF DATA PROCESSING IS BASED ON ART. 6 PARA. 1 LIT. E OR F GDPR, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF YOUR PERSONAL DATA FOR REASONS ARISING FROM YOUR PARTICULAR SITUATION; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR AFFECTED PERSONAL DATA UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING THAT OVERRIDE YOUR INTERESTS, RIGHTS, AND FREEDOMS OR THE PROCESSING SERVES THE ESTABLISHMENT, EXERCISE, OR DEFENSE OF LEGAL CLAIMS (OBJECTION UNDER ART. 21 PARA. 1 GDPR).

IF YOUR PERSONAL DATA IS PROCESSED FOR DIRECT MARKETING PURPOSES, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF YOUR PERSONAL DATA FOR THE PURPOSE OF SUCH MARKETING; THIS ALSO APPLIES TO PROFILING INSOFAR AS IT IS ASSOCIATED WITH SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL NO LONGER BE USED FOR DIRECT MARKETING PURPOSES (OBJECTION UNDER ART. 21 PARA. 2 GDPR).

Right to Lodge a Complaint with a Supervisory Authority

In the event of violations of the GDPR, the data subjects have the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, place of work, or the place of the alleged violation. The right to lodge a complaint exists without prejudice to other administrative or judicial remedies.

Right to Data Portability

You have the right to have data that we process automatically on the basis of your consent or in fulfillment of a contract handed over to you or a third party in a common, machine-readable format. If you request the direct transfer of the data to another responsible party, this will only be done to the extent technically feasible.

SSL or TLS Encryption

This site uses SSL or TLS encryption for security reasons and to protect the transmission of confidential content, such as orders or inquiries that you send to us as the site operator. You can recognize an encrypted connection by the fact that the address line of the browser changes from “http://” to “https://” and by the lock symbol in your browser line.

If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

Encrypted Payment Transactions on this Website

If, after concluding a fee-based contract, there is an obligation to provide us with your payment data (e.g., account number in the case of direct debit authorization), these data will be required for payment processing.

Payment transactions via the usual means of payment (Visa/MasterCard, direct debit) are carried out exclusively via an encrypted SSL or TLS connection. You can recognize an encrypted connection by the fact that the address line of the browser changes from “http://” to “https://” and by the lock symbol in your browser line.

With encrypted communication, your payment data that you transmit to us cannot be read by third parties.

Information, Deletion, and Correction

Within the scope of the applicable legal provisions, you have the right at any time to free information about your stored personal data, its origin and recipients, and the purpose of the data processing and, if necessary, a right to correction or deletion of this data. You can contact us at any time regarding this and other questions on the subject of personal data.

Right to Restrict Processing

You have the right to request the restriction of the processing of your personal data. To do this, you can contact us at any time. The right to restrict processing exists in the following cases:

  • If you dispute the accuracy of your personal data stored by us, we usually need time to verify this. For the duration of the verification, you have the right to request the restriction of the processing of your personal data.
  • If the processing of your personal data was/is unlawful, you can request the restriction of data processing instead of deletion.
  • If we no longer need your personal data, but you need it to establish, exercise, or defend legal claims, you have the right to request the restriction of the processing of your personal data instead of deletion.
  • If you have lodged an objection under Art. 21 para. 1 GDPR, a balance must be struck between your and our interests. As long as it has not yet been determined whose interests prevail, you have the right to request the restriction of the processing of your personal data.

If you have restricted the processing of your personal data, this data may – apart from being stored – only be processed with your consent or for the establishment, exercise, or defense of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the European Union or a Member State.

Objection to Advertising Emails

We hereby object to the use of contact data published within the framework of the legal notice obligation for the transmission of unsolicited advertising and information material. The operators of these pages expressly reserve the right to take legal action in the event of unsolicited sending of advertising information, such as spam e-mails.

4. Data Collection on this Website

Cookies

Our websites use so-called “cookies.” Cookies are small text files that do not cause any damage to your terminal device. They are either stored temporarily for the duration of a session (session cookies) or permanently (permanent cookies) on your terminal device. Session cookies are automatically deleted after your visit. Permanent cookies remain stored on your terminal device until you delete them yourself or until your web browser automatically deletes them.

In some cases, cookies from third-party companies may also be stored on your terminal device when you enter our site (third-party cookies). These enable us or you to use certain services of the third-party company (e.g., cookies for processing payment services).

Cookies have various functions. Many cookies are technically necessary, as certain website functions would not work without them (e.g., the shopping cart function or displaying videos). Other cookies are used to evaluate user behavior or to display advertising.

Cookies that are necessary to carry out the electronic communication process, to provide certain functions you have requested (e.g., for the shopping cart function), or to optimize the website (e.g., cookies for measuring the web audience) are stored on the basis of Art. 6 para. 1 lit. f GDPR, unless another legal basis is specified. The website operator has a legitimate interest in storing necessary cookies for the technically error-free and optimized provision of their services. If consent was requested to store cookies and comparable recognition technologies, the processing is carried out exclusively on the basis of this consent (Art. 6 para. 1 lit. a GDPR and § 25 para. 1 TTDSG); the consent can be revoked at any time.

You can set your browser so that you are informed about the setting of cookies and allow cookies only in individual cases, exclude the acceptance of cookies for certain cases or in general, and activate the automatic deletion of cookies when closing the browser. If cookies are deactivated, the functionality of this website may be restricted.

Insofar as cookies from third-party companies or for analysis purposes are used, we will inform you about this separately within the framework of this privacy policy and, if necessary, request your consent.

Consent with Borlabs Cookie

Our website uses the consent technology of Borlabs Cookie to obtain your consent to store certain cookies in your browser or to use certain technologies and to document them in a data protection-compliant manner. The provider of this technology is Borlabs – Benjamin A. Bornschein, Rübenkamp 32, 22305 Hamburg (hereinafter referred to as Borlabs).

When you enter our website, a Borlabs cookie is stored in your browser, in which the consents you have given or the revocation of these consents are stored. This data is not passed on to the provider of Borlabs Cookie.

The collected data will be stored until you request us to delete it, delete the Borlabs cookie yourself, or the purpose for storing the data no longer applies. Mandatory legal retention periods remain unaffected. You can find details about Borlabs Cookie’s data processing at https://de.borlabs.io/kb/welche-daten-speichert-borlabs-cookie/.

The use of Borlabs cookie consent technology is done to obtain the legally required consents for the use of cookies. The legal basis for this is Art. 6 para. 1 lit. c GDPR.

Server Log Files

The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:

  • Browser type and version
  • Operating system used
  • Referrer URL
  • Hostname of the accessing computer
  • Time of the server request
  • IP address

This data will not be combined with other data sources.

The collection of this data is based on Art. 6 para. 1 lit. f GDPR. The website operator has a legitimate interest in the technically error-free presentation and optimization of their website – for this purpose, the server log files must be recorded.

Contact Form

If you send us inquiries via the contact form, your details from the inquiry form, including the contact details you provided there, will be stored by us for the purpose of processing the inquiry and in case of follow-up questions. We do not pass on this data without your consent.

The processing of this data is based on Art. 6 para. 1 lit. b GDPR if your request is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective processing of requests addressed to us (Art. 6 para. 1 lit. f GDPR) or on your consent (Art. 6 para. 1 lit. a GDPR) if this has been requested; the consent can be revoked at any time.

The data you enter in the contact form will remain with us until you request deletion, revoke your consent to storage, or the purpose for storing the data no longer applies (e.g., after your request has been processed). Mandatory legal provisions – especially retention periods – remain unaffected.

Inquiry by Email, Phone, or Fax

If you contact us by e-mail, phone, or fax, your inquiry, including all resulting personal data (name, inquiry), will be stored and processed by us for the purpose of processing your request.

The data sent by you via contact inquiries will remain with us until you request deletion, revoke your consent to storage, or the purpose for data storage no longer applies (e.g., after your request has been processed). Mandatory statutory provisions – in particular, statutory retention periods – remain unaffected.

Communication via WhatsApp

We use the instant messaging service WhatsApp for communication with our customers and other third parties. The provider is WhatsApp Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland.

Communication is encrypted end-to-end (peer-to-peer), preventing WhatsApp or third parties from accessing the communication content. However, WhatsApp gains access to metadata arising during the communication process (e.g., sender, recipient, and timestamp). Furthermore, WhatsApp states that it shares personal data of its users with its US-based parent company Meta. For further details on data processing, please refer to WhatsApp’s privacy policy at https://www.whatsapp.com/legal/#privacy-policy.

The use of WhatsApp is based on our legitimate interest in the fastest and most effective communication with customers, prospects, and other business and contractual partners (Art. 6 para. 1 lit. f GDPR). If consent was requested, the processing is carried out exclusively on the basis of consent; the consent can be revoked at any time with effect for the future.

The communication content exchanged between you and us on WhatsApp will remain with us until you request deletion, revoke your consent to storage, or the purpose for data storage no longer applies (e.g., after processing your request has been completed). Mandatory legal provisions – especially retention periods – remain unaffected.

The company has a certification according to the “EU-US Data Privacy Framework” (DPF). The DPF is an agreement between the European Union and the USA that ensures compliance with European data protection standards in data processing in the USA. Each company certified under the DPF is committed to complying with these data protection standards. You can find more information about this from the provider at the following link: https://www.dataprivacyframework.gov/s/participant-search/participant-detail?contact=true&id=a2zt00000011sfnAAA&status=Active

We use WhatsApp in the “WhatsApp Business” variant.

The data transfer to the USA is based on the EU Commission’s standard contractual clauses. Details can be found here: https://www.whatsapp.com/legal/business-data-transfer-addendum.

We have configured our WhatsApp accounts so that there is no automatic data synchronization with the address book on the smartphones used.

We have concluded a contract for order processing (AVV) with the above-mentioned provider.

Registration on this Website

You can register on this website to use additional functions on the site. The data entered for this purpose will only be used for the purpose of using the respective offer or service for which you have registered. The mandatory information requested during registration must be provided in full. Otherwise, we will reject the registration.

In the case of important changes, for example, in the scope of the offer or in the case of technically necessary changes, we will use the e-mail address provided during registration to inform you in this way.

The processing of the data entered during registration is based on the fulfillment of a contract or pre-contractual measures (Art. 6 para. 1 lit. b GDPR).

The data collected during registration will be stored by us as long as you are registered on this website and will be deleted afterward. Statutory retention periods remain unaffected.

Comment Function on this Website

For the comment function on this page, in addition to your comment, details on the time the comment was created, your e-mail address, and, if you are not posting anonymously, the username you have chosen will be stored.

Storage of the IP Address

Our comment function stores the IP addresses of users who post comments. Since we do not check comments on this website before they are activated, we need this data to be able to take action against the author in the case of legal violations such as insults or propaganda.

Subscribing to Comments

As a user of the site, you can subscribe to comments after registering. You will receive a confirmation e-mail to verify that you are the owner of the specified e-mail address. You can unsubscribe from this function at any time via a link in the info mails. In this case, the data entered when subscribing to comments will be deleted; if you have transmitted this data to us for other purposes and in another place (e.g., newsletter subscription), this data will remain with us.

Retention Duration of Comments

The comments and the associated data will be stored and remain on this website until the commented content has been completely deleted or the comments must be deleted for legal reasons (e.g., offensive comments).

Legal Basis

The storage of comments is based on your consent (Art. 6 para. 1 lit. a GDPR). You can revoke any consent you have given at any time. A simple e-mail to us is sufficient. The legality of the data processing operations already carried out remains unaffected by the revocation.

5. Analysis Tools and Advertising

Google Tag Manager

We use Google Tag Manager. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.

Google Tag Manager is a tool that allows us to integrate tracking or statistical tools and other technologies on our website. However, Google Tag Manager captures your IP address, which may also be transmitted to Google’s parent company in the United States.

The use of Google Tag Manager is based on Art. 6 para. 1 lit. f GDPR. The website operator has a legitimate interest in the quick and uncomplicated integration and management of various tools on their website. If consent has been requested, processing is carried out exclusively on the basis of Art. 6 para. 1 lit. a GDPR and § 25 para. 1 TTDSG, insofar as the consent includes the storage of cookies or access to information on the user’s terminal device (e.g., device fingerprinting) within the meaning of the TTDSG. The consent can be revoked at any time.

The company is certified under the “EU-US Data Privacy Framework” (DPF). The DPF is an agreement between the European Union and the USA to ensure compliance with European data protection standards in data processing in the USA. Google Analytics

This website uses functions of the web analysis service Google Analytics. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Analytics allows the website operator to analyze the behavior of website visitors. In doing so, the website operator receives various usage data, such as page views, length of stay, operating systems used, and the user’s origin. This data is assigned to the respective end device of the user. An assignment to a user ID does not take place.

In addition, we can use Google Analytics to record your mouse and scroll movements and clicks. Furthermore, Google Analytics uses various modeling approaches to supplement the data collected and applies machine learning technologies in data analysis.

Google Analytics uses technologies that allow the recognition of the user for the purpose of analyzing user behavior (e.g., cookies or device fingerprinting). The information collected by Google about the use of this website is usually transmitted to a Google server in the USA and stored there.

The use of this service is based on your consent according to Art. 6 para. 1 lit. a GDPR and § 25 para. 1 TTDSG. The consent can be revoked at any time.

The data transfer to the USA is based on the standard contractual clauses of the EU Commission. Details can be found here: https://privacy.google.com/businesses/controllerterms/mccs/.

Order Processing

We have concluded an order processing contract with Google and fully implement the strict requirements of the German data protection authorities when using Google Analytics.

Google Analytics E-Commerce Measurement

This website uses the “E-Commerce Measurement” feature of Google Analytics. With the help of e-commerce measurement, the website operator can analyze the purchasing behavior of website visitors to improve their online marketing campaigns. This involves recording information such as placed orders, average order values, shipping costs, and the time from viewing to purchasing a product. This data can be summarized by Google under a transaction ID, which is assigned to the respective user or their device.

Google Ads

The website operator uses Google Ads. Google Ads is an online advertising program of Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Ads allows us to display advertisements in Google’s search engine or on third-party websites when the user enters certain search terms in Google (keyword targeting). Furthermore, targeted advertisements can be displayed based on the user data available to Google (e.g., location data and interests) (audience targeting). We can analyze these data quantitatively by evaluating, for example, which search terms led to the display of our advertisements and how many ads led to corresponding clicks.

The use of this service is based on your consent according to Art. 6 para. 1 lit. a GDPR and § 25 para. 1 TTDSG. The consent can be revoked at any time.

The data transfer to the USA is based on the standard contractual clauses of the EU Commission. Details can be found here: https://policies.google.com/privacy/frameworks and https://business.safety.google/adscontrollerterms/sccs/.

We do not receive any information with which we can personally identify the user. Google itself uses cookies or comparable recognition technologies for identification.

The use of this service is based on your consent according to Art. 6 para. 1 lit. a GDPR and § 25 para. 1 TTDSG. The consent can be revoked at any time.

DoubleClick is used to display interest-based advertisements to you throughout the Google advertising network. The advertisements can be tailored to the interests of the respective viewer with the help of DoubleClick. Our ads can be displayed in Google search results or in banners linked to DoubleClick.

To show users interest-based advertising, DoubleClick must be able to recognize the respective viewer and associate them with their visited websites, clicks, and other information about user behavior. For this purpose, DoubleClick uses cookies or comparable recognition technologies (e.g., device fingerprinting). The collected information is summarized in a pseudonymous user profile to display interest-based advertising to the relevant user.

The use of this service is based on your consent according to Art. 6 para. 1 lit. a GDPR and § 25 para. 1 TTDSG. The consent can be revoked at any time.

Google AdSense (Non-Personalized)

This website uses Google AdSense, a service for embedding advertisements. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

We use Google AdSense in “non-personalized” mode. In contrast to the personalized mode, the advertisements are not based on your previous user behavior, and no user profile is created for you. Instead, “contextual information” is used to select the advertisements. The selected advertisements are then based, for example, on your location, the content of the website you are on, or your current search terms. You can find more information about the differences between personalized and non-personalized targeting with Google AdSense at: https://support.google.com/adsense/answer/9007336.

The DPF is an agreement between the European Union and the USA to ensure compliance with European data protection standards in data processing in the USA. Every company certified under the DPF is committed to complying with these data protection standards. 6. Newsletter

Newsletter Data

If you would like to receive the newsletter offered on the website, we require an e-mail address from you as well as information that allows us to verify that you are the owner of the provided e-mail address and agree to receive the newsletter. No further data will be collected, or only on a voluntary basis. We use this data exclusively for sending the requested information and do not pass it on to third parties.

The processing of the data entered in the newsletter registration form is based exclusively on your consent (Art. 6 para. 1 lit. a GDPR). You can revoke your consent to the storage of the data, the e-mail address, and its use for sending the newsletter at any time, for example, via the “unsubscribe” link in the newsletter. The legality of the data processing operations already carried out remains unaffected by the revocation.

The data stored by you for the purpose of receiving the newsletter will be stored by us or the newsletter service provider until you unsubscribe from the newsletter and deleted from the newsletter distribution list after unsubscribing. Data that has been stored by us for other purposes remains unaffected by this.

After unsubscribing from the newsletter distribution list, your e-mail address may be stored in a blacklist by us or the newsletter service provider if this is necessary to prevent future mailings. The data from the blacklist is used solely for this purpose and is not merged with other data. This serves both your interest and our interest in complying with the legal requirements for sending newsletters (legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR). Storage in the blacklist is not time-limited. You can object to the storage if your interests outweigh our legitimate interest.

7. Plugins and Tools

YouTube with Enhanced Data Protection

This website embeds YouTube videos. The operator of the pages is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

We use YouTube in enhanced privacy mode. According to YouTube, this mode ensures that YouTube does not store any information about visitors to this website before they view the video. However, the transmission of data to YouTube partners is not necessarily excluded by the enhanced privacy mode. Thus, YouTube – regardless of whether you watch a video – establishes a connection to the Google DoubleClick network.

As soon as you start a YouTube video on this website, a connection to the YouTube servers is established. In the process, the YouTube server is informed which of our pages you visited. If you are logged into your YouTube account, you enable YouTube to assign your browsing behavior directly to your personal profile. You can prevent this by logging out of your YouTube account.

Furthermore, YouTube may store various cookies on your terminal device after starting a video. With the help of these cookies, YouTube can obtain information about visitors to this website. This information is used, among other things, to collect video statistics, improve user experience, and prevent fraud attempts. The cookies remain on your terminal device until you delete them.

If necessary, further data processing operations may be triggered after starting a YouTube video, over which we have no control.

The use of YouTube is in the interest of an appealing presentation of our online offers. This constitutes a legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR. If consent has been requested, processing is carried out exclusively on the basis of Art. 6 para. 1 lit. a GDPR; the consent can be revoked at any time.

For more information on data protection at YouTube, please see their privacy policy at: https://policies.google.com/privacy?hl=en.

To use the functions of Google Maps, it is necessary to store your IP address. This information is usually transmitted to a Google server in the USA and stored there. The consent can be revoked at any time.

The data transfer to the USA is based on the standard contractual clauses of the EU Commission. Details can be found here: https://business.safety.google/controllerterms/ and https://business.safety.google/controllerterms/sccs/.

Processing Customer and Contract Data

We collect, process, and use personal customer and contract data for the establishment, content arrangement, and modification of our contractual relationships. We collect, process, and use personal data regarding the use of this website (usage data) only to the extent necessary to enable the user to use the service or bill for it. The legal basis for this is Art. 6 para. 1 lit. b GDPR.

The collected customer data will be deleted after the completion of the order or termination of the business relationship and the expiration of any existing statutory retention periods. Statutory retention periods remain unaffected.

Data Transfer upon Conclusion of a Contract for Online Stores, Dealers, and Goods Shipment

When you order goods from us, we pass on your personal data to the company entrusted with the delivery as well as to the payment service provider responsible for the payment processing. Only the data required by the respective service provider to fulfill their task will be disclosed. The legal basis for this is Art. 6 para. 1 lit. b GDPR, which allows the processing of data for the fulfillment of a contract or pre-contractual measures. If you have given your consent in accordance with Art. 6 para. 1 lit. a GDPR, we will pass on your e-mail address to the company entrusted with the delivery so that it can inform you by e-mail about the shipping status of your order; you can revoke your consent at any time.

Data Transfer upon Conclusion of a Contract for Services and Digital Content

We only transfer personal data to third parties if this is necessary in the context of the contract processing, for example, to the credit institution entrusted with the payment processing.

A further transfer of the data does not take place or only if you have expressly consented to the transfer. A further transfer of your data to third parties without explicit consent, for example, for advertising purposes, does not take place.

The basis for the data processing is Art. 6 para. 1 lit. b GDPR, which allows the processing of data for the fulfillment of a contract or pre-contractual measures.

9. Own Services

Handling Applicant Data

We offer you the opportunity to apply for a job with us (e.g., by e-mail, post, or via an online application form). In the following, we will inform you about the scope, purpose, and use of your personal data collected in the context of the application process. We assure you that the collection, processing, and use of your data will be carried out in accordance with applicable data protection law and all other statutory provisions and that your data will be treated confidentially.

Scope and Purpose of Data Collection

If you send us an application, we process your associated personal data (e.g., contact and communication data, application documents, notes during job interviews, etc.), as far as this is necessary to make a decision on establishing an employment relationship. The legal basis for this is § 26 BDSG under German law (initiation of an employment relationship), Art. 6 para. 1 lit. b GDPR (general contract initiation), and – if you have given consent – Art. 6 para. 1 lit. a GDPR. The consent can be revoked at any time. Your personal data will only be passed on within our company to persons involved in processing your application.

If the application is successful, the data you submitted will be stored in our data processing systems based on § 26 BDSG and Art. 6 para. 1 lit. b GDPR for the purpose of carrying out the employment relationship.

Data Retention Duration

If we cannot offer you a job, you reject a job offer, or you withdraw your application, we reserve the right to retain the data you submitted based on our legitimate interests (Art. 6 para. 1 lit. f GDPR) for up to 6 months from the end of the application process (rejection or withdrawal of the application). The data will then be deleted, and the physical application documents will be destroyed. The retention serves in particular as evidence in the event of a legal dispute. If it is apparent that the data will be required after the 6-month period (e.g., due to a pending or impending legal dispute), deletion will only occur when the purpose for the extended retention no longer applies.

A longer retention may also occur if you have given your consent (Art. 6 para. 1 lit. a GDPR) or if statutory retention obligations prevent deletion.

Inclusion in the Applicant Pool

If we do not offer you a job, there may be the possibility of including you in our applicant pool. In case of inclusion, all documents and details from the application will be transferred to the applicant pool in order to contact you in case of suitable vacancies.

Inclusion in the applicant pool is based exclusively on your express consent (Art. 6 para. 1 lit. a GDPR). The consent is voluntary and has no relation to the ongoing application process.

The applicant can revoke this consent at any time.

In this case, the data from the applicant pool will be irrevocably deleted, provided there are no legal retention obligations.

The data from the applicant pool will be irrevocably deleted no later than two years after consent has been given.

Complaints Regarding Personal Data

If you have any complaints regarding your personal data, we kindly ask you to contact us so that we can find a solution together. Additionally, you have the option to contact the Austrian Data Protection Authority.
